2. These terms
These terms apply when you use this shop or order goods from us. Please read them together with our Shipping and Delivery Policy, Returns, Cancellation and Refund Policy, Privacy Policy and the product information shown before checkout.
Nothing in these terms affects the legal rights available to consumers under UK law.
3. Products and information
We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly between screens and printed goods may have minor production differences.
Please check the product title, edition, version and assessment-date information carefully before ordering a technical or training manual. If you are unsure whether a manual is suitable for your course or assessment, check with your training centre before placing the order.
Product availability can change. If an item becomes unavailable after you order, we will contact you and refund any payment taken for that item.
4. Orders and acceptance
Placing an order is an offer to buy the goods in your basket. We will acknowledge receipt of your order by email. A contract is formed when we send you confirmation that the order has been accepted or dispatched.
We may decline or cancel an order before acceptance where, for example, the product is unavailable, there is an obvious pricing or description error, payment cannot be authorised, the delivery address is outside our available area, or we reasonably suspect fraud or misuse. If we cancel after taking payment, we will refund the affected amount.
Please check your order and contact details before submitting them. If you notice a mistake afterwards, contact us as soon as possible. We cannot guarantee that an order or address can be changed after dispatch.
5. Prices and payment
The product price and any delivery charge will be shown before you place your order. The total price payable, including any applicable taxes and delivery charges, will be shown at checkout before payment.
Payment is processed using the payment methods offered at checkout. We do not receive your full payment-card details.
If an obvious pricing error is discovered before we accept the order, we will contact you and give you the choice of continuing at the correct price or cancelling for a refund.
6. Delivery
We currently deliver to UK addresses accepted by checkout, including Northern Ireland and the Scottish Highlands and islands. We do not currently deliver to the Channel Islands or the Isle of Man.
The delivery service, charge and estimated timescale are set out in our Shipping and Delivery Policy and shown at checkout. Delivery dates are estimates, but we will deliver without undue delay and no later than 30 days after accepting the order unless we agree otherwise with you.
For a consumer order, responsibility for accidental loss of or damage to the goods passes to you when you, or a person you nominate, takes physical possession of them. This does not include a carrier you selected where we did not offer that carrier as an option.
7. Cancellation, returns and refunds
Consumers buying online normally have the right to tell us they wish to cancel within 14 days after the day the goods are received, followed by a further 14 days to return them. The procedure, return address, return-cost rules, refund timing and model cancellation form are set out in our Returns, Cancellation and Refund Policy.
Different rules apply where goods are faulty, damaged, incorrect or misdescribed. Nothing in these terms or our policies reduces your statutory rights.
If you are purchasing wholly or mainly for business use, consumer change-of-mind rights may not apply. Business change-of-mind returns require our prior agreement, but this does not affect rights relating to faulty, damaged, incorrect or misdescribed goods.
8. Our responsibility to consumers
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was formed.
We do not exclude or limit responsibility where it would be unlawful to do so. This includes responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where the law imposes responsibility, and your statutory rights in relation to goods.
When you buy as a consumer, we are not responsible for business losses such as loss of profit, revenue, business opportunity or business interruption.
9. Events outside our reasonable control
We are not responsible for delay caused by an event outside our reasonable control where we have taken reasonable steps to minimise the effect. We will contact you as soon as reasonably possible if such an event materially affects your order. Your legal rights, including rights relating to serious delivery delay, remain unaffected.
10. Website use and intellectual property
The shop and its content may be used for lawful personal or business purchasing. You must not misuse the site, attempt unauthorised access, introduce malicious code, interfere with its operation, or use it in a way that infringes another person's rights.
The shop's branding, text, layout and original content belong to TomKat Gas Training Limited or are used with permission. Product names, manuals, cover artwork and other third-party material remain the property of their respective owners. No ownership rights are transferred to you by viewing the site or buying a product.
11. Personal information
Our Privacy Policy explains how personal information is collected and used. Shopify also processes information to provide the ecommerce and payment platform.
12. Changes to these terms
We may update these terms for future use where our services, business practices or legal obligations change. The terms that apply to an order are the terms made available when that order is placed. We will not use a later change to reduce rights already attached to an accepted order.
13. Governing law and disputes
These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you also retain any mandatory protections available to you there and may bring proceedings in the courts of the part of the United Kingdom where you live.
Please contact us first if you have a problem so we can try to resolve it. This does not restrict your right to seek independent advice or use the courts or another lawful dispute-resolution route.
